1. Definitions
- "Heirvale", "we", "us", "our" refers to Heirvale, operating at 33, Jalan Telawi 5, Bangsar Baru, 59100 Kuala Lumpur, Malaysia.
- "Programme" refers to any educational session or service offered by Heirvale, including the Legacy Orientation Session, Records Organisation Service, and Family Legacy Companion Programme.
- "User", "you" refers to any individual who accesses our website or enrols in a programme.
- "Website" refers to the site accessible at heirval.blog.
- "Agreement" refers to these Terms & Conditions, taken together with our Privacy Policy and Cookie Policy.
2. Acceptance of Terms
By using this website or enrolling in any Heirvale programme, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the website or enrol. You must be at least 18 years of age to use our services or enter into this Agreement.
3. Nature of Services — Important Disclaimer
Heirvale provides educational information and record-organisation assistance only. Nothing on this website or in any programme constitutes legal advice, legal representation, financial advice, or any service that requires a professional licence in Malaysia. All formal decisions — including those relating to wills, estates, property transfers, or probate — must be made with the guidance of appropriately licensed professionals.
We expressly disclaim any responsibility for decisions made by users on the basis of information received through our website or programmes. Users are encouraged to consult licensed solicitors, estate administrators, and relevant official bodies for all formal matters.
4. Service Description and Availability
Our programmes are designed for adults based in Malaysia who wish to understand how estate organisation generally works and to get their own personal records in order. Programmes are delivered in English. We offer both in-person sessions at our Bangsar Baru office and online sessions via video call. Services are available Monday to Friday, 9:00 am to 6:00 pm, and Saturday, 10:00 am to 2:00 pm.
We reserve the right to modify, suspend, or discontinue any programme at any time with reasonable notice where possible.
5. Enrolment and Programme Scope
Enrolment in a programme is confirmed upon receipt of payment and a written programme summary from Heirvale outlining the scope. The scope is fixed at the time of enrolment. Any requests to expand the scope after the programme has commenced will be treated as a new enquiry and may attract additional fees.
Participants are responsible for providing accurate information during enrolment and for attending scheduled sessions. Rescheduling is possible with at least 48 hours' notice.
6. Payment Terms
Fees are quoted and payable in Malaysian Ringgit (RM). Programme fees are as follows at the time of publication:
- Legacy Orientation Session: RM 560
- Records Organisation Service: RM 2,100
- Family Legacy Companion Programme: RM 4,450
Payment is due prior to the first session unless otherwise agreed in writing. Accepted payment methods will be confirmed at the time of enrolment. Fees are subject to change; any change will be communicated before it applies to existing enrolments.
7. Cancellation and Refund Policy
- Cancellation more than 7 days before the first session: full refund of any amount paid.
- Cancellation 3–7 days before the first session: 50% refund.
- Cancellation less than 3 days before the first session or after the first session has taken place: no refund, but the programme may be rescheduled once at our discretion.
- If Heirvale cancels a session, a full refund or rescheduled session will be offered.
8. Intellectual Property
All educational materials, checklists, glossaries, folder systems, and written resources provided by Heirvale are the intellectual property of Heirvale. They are provided for the personal, non-commercial use of the enrolled participant only. You may not reproduce, distribute, or publish any Heirvale materials without prior written consent.
9. User Responsibilities
- Provide accurate and complete information during enquiry and enrolment
- Use programme materials for personal purposes only, not for commercial redistribution
- Treat staff and facilitators with respect during all sessions
- Not represent educational information received from Heirvale as legal or professional advice to third parties
10. Confidentiality
Documents and personal information shared with us during a programme are treated as confidential. We do not share them with third parties except as required by law. Participants are equally expected to treat any materials or session notes as personal records and not share them in ways that could misrepresent Heirvale's services.
11. Disclaimers
Our educational content is provided in good faith for general information purposes. We make reasonable efforts to ensure accuracy, but we do not warrant that all information is complete, current, or free from error. The information provided is not a substitute for professional legal, financial, or estate planning advice tailored to your individual circumstances.
Outcomes from using our services — including how well-prepared you feel for formal professional consultations — depend on factors outside our control. We do not make any assurances about specific results.
12. Limitation of Liability
To the fullest extent permitted under Malaysian law, Heirvale shall not be liable for any indirect, incidental, or consequential loss or damage arising from use of our website or programmes. Our total liability for any claim arising under this Agreement shall not exceed the fee paid for the specific programme to which the claim relates.
Nothing in these terms excludes or limits liability for fraud or for death or personal injury caused by negligence.
13. Indemnification
You agree to indemnify and hold harmless Heirvale and its staff from any claims, losses, or expenses (including reasonable legal fees) arising from your misuse of our services, breach of these Terms, or any claim that information you provided was inaccurate.
14. Termination
Heirvale reserves the right to terminate a programme engagement if a participant's conduct is disrespectful, if fraudulent or inaccurate information was provided at enrolment, or if payment is not received as agreed. In such cases, a pro-rated refund for uncompleted sessions may be offered at our discretion. Participants may withdraw from a programme at any time subject to the cancellation and refund terms in Section 7.
15. Governing Law and Dispute Resolution
These Terms & Conditions are governed by and construed in accordance with the laws of Malaysia. Any dispute arising under or in connection with this Agreement shall first be referred to informal resolution by contacting us at [email protected]. If the dispute cannot be resolved informally within 30 days, it shall be referred to the courts of Malaysia, with the courts of Kuala Lumpur having non-exclusive jurisdiction.
16. General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Heirvale in relation to your use of our services.
- Severability: If any provision of these Terms is found to be unenforceable, it shall be severed and the remaining provisions shall continue in full force.
- Waiver: Failure by Heirvale to enforce any provision does not constitute a waiver of that provision.
- Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign ours in connection with a business transfer.
17. Changes to These Terms
We may update these Terms from time to time. Material changes will be noted with a revised "Last Updated" date. Continued use of our website or services after such changes constitutes acceptance. We encourage you to review this page periodically.
